X5's adaptive cruise control not working properly - what to do?

I'm experiencing issues with my X5's adaptive cruise control, it's not engaging properly even when set to minimum following distance. Speed is being maintained but it fails to adjust speed according to traffic or other vehicles on the road. Anyone else encountered this problem? Have I missed any software updates? What could be the possible cause of this malfunction and how can I resolve it?
